Gatekeeper Improvement Act

What must you do when someone is ill?

In the Netherlands, the Gatekeeper Improvement Act (Wet verbetering poortwachter) sets fixed steps and deadlines for employers during the two years an employee is ill. For each moment you see what the law requires from you and what we do for you.

Day 1Sick reportYou as the employerReport your employee sick, preferably on the first day of illness.React2uWe get in touch and open the file.
Week 6Problem analysisYou as the employerThe company doctor (bedrijfsarts) draws up a problem analysis (probleemanalyse) by week 6 at the latest.React2uWe schedule the consultation and share the advice with you.
Week 8Action planYou as the employerTogether with your employee you draw up an action plan (plan van aanpak).React2uWe guide the plan and record the agreements.
Every 6 weeksEvaluationYou as the employerDiscuss progress and adjust the plan where needed.React2uWe schedule the evaluations and record them in the file.
Week 42Sick report to UWVYou as the employerReport the illness to UWV, the Dutch Employee Insurance Agency, by week 42 at the latest.React2uWe alert you in time for the report.
Week 52First-year evaluationYou as the employerEvaluate the first year of illness (eerstejaarsevaluatie) and agree the plan for year two.React2uWe prepare the evaluation together with you.
Around week 91WIA applicationYou as the employerYour employee applies for WIA benefit (Work and Income according to Labour Capacity Act); you provide the reintegration report (re-integratieverslag).React2uWe compile the report from the file.
Up to 2 yearsContinued salary paymentYou as the employerYou continue to pay salary for up to 104 weeks, in line with the law and your collective agreement (cao).React2uWe make sure the file is complete for UWV.
Beware of the wage sanctionIf UWV decides too little was done about reintegration, it can impose a wage sanction (loonsanctie): up to one extra year of salary payments. That is why we keep track of every deadline.More about React2u Recover

Am I required to have an occupational health service?

Yes. Under the Dutch Working Conditions Act (Arbowet) every employer must arrange expert support for sickness absence and healthy working, including at least a company doctor (bedrijfsarts). You record this in a basic contract (basiscontract).

What is in the basic contract?

Among other things: open consultation hours with the company doctor, the right to a second opinion, a complaints procedure and the option for the company doctor to visit the workplace.

Can we switch from another occupational health service?

Yes. We take over ongoing absence cases, so no deadline is missed.

How quickly is there contact after a sick report?

Your case manager contacts your employee within one working day.
